These Terms & Conditions (the “Terms”) govern your access to and use of our website and services, and your purchase of products from us. Please read them carefully.

1) Acceptance of Terms

By accessing our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced here, including our Shipping & Delivery Policy, Return & Refund Policy, and Privacy Policy. If you do not agree, please do not use our website or purchase our products.

3) Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from our website. By placing an order, you represent that you meet this requirement and that all information you provide is truthful and accurate.

4) Products & Availability

We offer a range of toys and children’s products as listed on our website, including but not limited to ride-on cars, bikes, educational toys, games and accessories. All items and prices are subject to availability and may change without notice. We may limit quantities per order, per household, or per account, and we may discontinue any product at any time.

5) Pricing, Taxes & Promotions

All prices are listed in Kenyan Shillings (KES). We reserve the right to adjust prices at any time. If a pricing or typographical error occurs, we may cancel any affected order and refund any amounts paid.

Prices are exclusive of VAT and any applicable taxes; any taxes, fees, or duties will be shown at checkout where applicable. Promotions, coupon codes, and discounts are subject to their own terms and may be modified, restricted, or ended at any time.

6) Orders & Payment

An order is an offer to purchase the selected items. We may accept or reject orders at our sole discretion, including for suspected fraud, product unavailability, or errors. Order acceptance occurs when we send a dispatch/shipping confirmation.

We accept payments via M-Pesa and cards (VISA & MASTERCARD). All payment information must be accurate, and you must be authorized to use the chosen payment method. Refer Terms & conditions.

7) Shipping & Delivery

We deliver nationwide within Kenya using trusted couriers and rider networks. Orders placed by our daily cut-off time (3 pm) are typically processed the same day; orders placed after the cut-off time are processed the next working day.

Estimated delivery times:

• Nairobi County – typically same day or next day.

• Other counties – typically the next day.

• Remote or outlying areas – usually 1–2 days depending on courier routing.

Delivery generally occurs between 8:00 am and 6:00 pm. Delivery fees are shown at checkout before payment. For full details, please refer to our Shipping & Delivery Policy.

8) Risk of Loss & Title

Risk of loss passes to you upon delivery to the address you provided or upon handover to you (or your designated recipient). Title to items transfers when payment is received in full. Please ensure that your address and contact information are accurate and that someone is available to receive the delivery.

9) Returns, Exchanges & Refunds

Returns and exchanges are governed by our Return & Refund Policy, which forms part of these Terms. Please review that policy for eligibility, timeframes, and the step-by-step process.

For safety and product integrity reasons, some items (for example, items that have been assembled, used, or damaged by misuse) may only be eligible for return under specific conditions (such as unused, unassembled, and in original packaging). Where applicable, refunds are issued to the original payment method.

10) Warranties & Disclaimers

Some items may come with a manufacturer’s or distributor’s warranty; where applicable, details are provided with the product or on the product page.

Except as expressly stated, our products and services are provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of Liability

To the maximum extent permitted by Kenyan law, Funzone Toys, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our website or purchase of products.

Our total liability for any claim arising out of or relating to a purchase shall not exceed the amount you paid for the specific product giving rise to the claim.

12) Prohibited Uses & Compliance

You agree not to misuse the website or purchase products for any unlawful or prohibited purpose. You will comply with all applicable laws and regulations when using our website and products.

You also agree not to:

• Attempt to interfere with or compromise the security or proper functioning of the Website.

• Use our content or products for fraudulent, misleading, or harmful activities.

We reserve the right to refuse service, cancel orders, or restrict access where we reasonably suspect abuse or violation of these Terms.

All content on our website, including text, graphics, logos, icons, images, product descriptions, and software, is the property of Funzone Toys or its licensors and is protected by intellectual property laws.

We handle personal data in accordance with our Privacy Policy and the Kenya Data Protection Act, 2019. We are not liable for delays or failure to perform our obligations due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, strikes, labour disputes, governmental actions, power outages, pandemics, or disruptions to transportation or telecommunications networks.

18) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. If a dispute arises, the parties shall first attempt to resolve it amicably within 30 days of written notice. If the dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, unless otherwise required by law.

19) Severability & Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

No waiver by us of any breach or default will be deemed a waiver of any subsequent breach or default.

20) Changes to the Terms

We may update these Terms from time to time. The “Updated” date at the top indicates when these Terms were last revised. Material changes will be posted on our website.

Your continued use of the Website or purchase of products after changes are posted constitutes acceptance of the updated Terms.
